Terms of Use

Effective October 13, 2026

These terms apply to the Chess Coach Andre online classroom at classroom.chesscoachandre.com ("the classroom"), run by Andre Gorostiaga, doing business as Chess Coach Andre, on Maui, Hawaii ("we", "us", "your coach"). By creating an account or using the classroom, you agree to these terms and to our Privacy Policy. If you're agreeing for a child, you agree on their behalf and are responsible for their use of the classroom.

1. Who can use the classroom

You can create your own account if you're 13 or older. Children under 13 need a parent or legal guardian to create and manage their account. Keep your password private, and tell us if you think someone else has used your account.

2. Lessons, bookings and payment

Lessons are booked and paid for on chesscoachandre.com. The booking, payment, cancellation and refund terms shown there apply to your lessons. The classroom is where lessons take place, along with your homework and recordings.

3. Being respectful in the classroom

• Be kind and respectful to your coach and anyone else in the classroom, in the video call and in the chat.
• Don't share your classroom link with people who aren't part of your lessons.
• Don't record, screenshot or share anyone else's camera, voice or messages without their permission.
• Don't try to break, overload or get around the classroom's security, or use it for anything unlawful.

We may end a lesson, or suspend or close an account, if these rules are broken.

4. Lesson recordings

Your coach may record lessons so you can watch them again. You're always told when a lesson is being recorded. Your camera and voice are included only if you agree (or, for a child, the parent agrees), and you can change that at any time. Recordings in your library are for your own personal learning. Please don't post them online or share them with others.

5. Lesson materials

Lessons, homework, recordings, notes and other teaching materials from your coach belong to Chess Coach Andre. You may use them for your own personal, non-commercial learning, but you may not copy, sell or publish them. The chess engine (Stockfish), chess pieces and sounds on the site are open-source or public-domain works used under their own licenses (see the credits at the bottom of each page).

Positions you save and messages you write stay yours. You allow us to store and show them to you and your coach so the classroom works.

6. The service

We work to keep the classroom running well, but we can't promise it will always be available or free of errors. Video quality depends on your internet connection and device. We may change, improve or stop parts of the classroom. If we ever close the classroom, we'll give students notice where we can, so they can download their data.

7. Disclaimers

The classroom is provided "as is". Chess instruction can't guarantee any particular result, rating or tournament outcome. To the extent the law allows, we disclaim all warranties not stated in these terms.

8. Limitation of liability

To the extent the law allows, Chess Coach Andre isn't liable for indirect, incidental or consequential damages, or for lost data, arising from use of the classroom. Our total liability for any claim relating to the classroom is limited to the amount you paid for lessons in the three months before the claim. Nothing in these terms limits liability that can't be limited by law.

9. Closing your account

You can delete your account at any time from your library ("Account and privacy"). We may close accounts that break these terms or haven't been used for a long time. If we close one for inactivity, we'll email you first.

10. Governing law

These terms are governed by the laws of the State of Hawaii. Any dispute will be handled in the courts for the County of Maui, Hawaii, unless the law where you live says otherwise. We'd always rather talk first: please email us if something isn't right.

11. Changes

If these terms change, we'll update the date at the top. If the change is important, we'll ask you to review and agree again the next time you sign in.
